The first development that could make Trump free and clear is the November 12 deadline that Judge Juan Merchan has set for deciding whether or not his conviction on 34 felony counts in his New York hush money case should stand, following the Supreme Court‘s ‘immunity’ decision.
That offers an off-ramp if Merchan wants to wipe his hands of the case entirely, although some legal experts don’t think it will hold up on the merits.
Many of the details of the case – ‘hush’ payments Trump provided to porn star Stormy Daniels through reimbursements to his lawyer during the 2016 campaign – could be cast as ‘private’ actions outside the perimeter of presidential authority the Court was seeking to safeguard.
But there was testimony in the case about Trump’s conversations with former fixer Michael Cohen in the Oval Office during his presidency, bringing the case in the vicinity of his tenure.
